Terms of Use
Effective:
The short version: Space Dodge 3D is free to play and licensed to you under the App Store or Google Play terms. Optional purchases are sold by Apple or Google; coins have no real-world value. Your progress lives only on your device, so deleting the game deletes it. The game is provided as is by one independent developer.
1. Agreement
These terms cover your use of the Space Dodge 3D game for iPhone and Android, made by Lukasz Blachura, an independent developer in Poland ("I", "me"). If you got the game from the App Store, your use is also governed by Apple's Licensed Application End User License Agreement; if you got it from Google Play, by the Google Play Terms of Service. The Space Dodge 3D Privacy Policy applies too. If these terms conflict with the store's terms, the store's terms take precedence. If you don't agree, please don't use the game.
2. Licence and permitted use
You may play Space Dodge 3D for personal, non-commercial entertainment on devices you own or control, as the store's usage rules allow. You agree not to:
- cheat, hack or modify the game, or use tools that alter coins, purchases or scores;
- reverse engineer, decompile or try to extract its source code, except where the law allows it;
- resell, rent or redistribute the game, or sell accounts, coins or items;
- use the game in a way that breaks the law.
3. Coins and virtual items
- Coins, ships, weapons, upgrades and other in-game items are a limited licence to use content inside the game. They are not your property, have no real-world monetary value and can't be exchanged for money or transferred to anyone else.
- Coins can be earned by playing or bought in coin packs. Coins are stored only on your device and cannot be restored if the game is deleted or its data is cleared.
- Mystery boxes are free, one per day, and can't be bought.
- I may rebalance prices, rewards and items in updates to keep the game fair and fun.
4. In-app purchases and refunds
- What's on sale: coin packs (consumable, used up when spent) and three one-time, non-consumable purchases: Remove Ads, the Starter Pack and the Battle Pass. There are no subscriptions.
- Price: shown in your local currency in the game before you buy, and charged by Apple or Google to your store account when you confirm.
- Restoring: non-consumable purchases can be restored on any device signed in with the same Apple ID or Google account, from Settings, then Restore Purchases in the game. Consumable coin packs can't be restored once added to your balance.
- Battle Pass: unlocks the Battle Pass rewards for the season it's bought in. Rewards must be claimed while that season is running; unclaimed rewards expire when the season ends.
- Remove Ads: turns off interstitial ads permanently on that store account. Rewarded ads, which you choose to watch, may still be offered.
- Refunds: handled by Apple or Google under their policies, at reportaproblem.apple.com or through Google Play. I can't issue refunds directly because I never receive your payment details.
- EU right of withdrawal: by confirming a purchase, you ask for the digital content to be delivered straight away and acknowledge that you lose the 14-day right of withdrawal once delivery starts. This doesn't affect Apple's or Google's own refund policies.
5. Ads
The game shows ads served by Google AdMob, as described in the Privacy Policy. I don't control the content of individual ads, and products advertised are offered by their advertisers, not by me. Rewarded ads give their reward after the ad completes; if an ad isn't available, no reward is owed.
6. Your progress
Space Dodge 3D has no account and stores progress only on your device. That means I cannot see, recover or transfer your progress or coins. Deleting the game, clearing its data or moving to a new device without restoring a device backup will reset them.
7. Intellectual property and gameplay videos
The Space Dodge 3D name, icon, artwork, music and code belong to me or my licensors. You're welcome to record and share gameplay videos, screenshots and streams, including on monetised YouTube or Twitch channels, as long as you don't suggest they are official or endorsed by me.
8. Availability and changes
I may update the game, change or remove features and content, or stop offering it. Because the game runs on your device without a server, it keeps working with your existing progress as long as it's installed and your device supports it.
9. Disclaimer
Space Dodge 3D is provided "as is" and "as available". I work hard to make it reliable, but I can't promise it will be error-free or uninterrupted. To the extent the law allows, I disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the extent the law allows, I am not liable for indirect, incidental or consequential losses, or for loss of progress or virtual items, arising from your use of the game. My total liability is limited to the amount you paid for in-app purchases in the 12 months before the claim. Nothing here limits rights you have under consumer protection law that cannot be excluded.
11. Governing law
These terms are governed by the laws of Poland. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.
